Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Momentumly, including the Momentumly Android application, momentumlyapp.com, Momentumly Pro, and related services. Momentumly is a Eureka Digital Media brand. By accessing or using Momentumly, you agree to these Terms. If you do not agree, do not use the service.

1. About Momentumly

Momentumly is a productivity and personal growth application that may include habit tracking, goals, progress updates, notes, journaling, mood check-ins, reminders, calendar tools, analytics, focus tools, themes, motivation, and related features. Features may change as the product develops.

2. Accounts and Account Security

Where account features are available, you are responsible for providing accurate information, maintaining the security of your account and device, and notifying us if you believe your account has been accessed without authorization. You may not impersonate another person or use Momentumly for unlawful or abusive purposes.

3. Account and Data Deletion

You may request deletion of your Momentumly account and associated user data through the app where available or through our external Account & Data Deletion page. Account deletion does not automatically cancel a Google Play subscription.

4. Free Features and Momentumly Pro

Momentumly may offer a free experience and paid Momentumly Pro subscriptions. Pro features may include unlimited habits, unlimited notes, unlimited calendar events, advanced reminders, deeper insights and productivity trends, Pro themes and custom colors, journal history access, focus tools, and an ad-free experience. Current features and pricing are shown in the app or on the pricing page and may change prospectively.

5. Google Play Billing, Renewal, Cancellation, and Refunds

Paid Android subscriptions or in-app purchases may be processed through Google Play. Billing, renewal, cancellation, and eligible refund handling are subject to Google Play terms and the information shown at purchase. You are responsible for reviewing subscription terms before confirming a purchase. Canceling a subscription prevents future renewal according to Google Play rules but does not necessarily delete your Momentumly account or data.

6. Acceptable Use

You agree not to misuse Momentumly, interfere with app or website operation, attempt unauthorized access, bypass security, introduce malicious code, scrape or copy protected content at scale, infringe intellectual property, harass others, use the service for illegal activity, or use Momentumly in a way that could damage the service or other users.

7. User Content

You retain responsibility for content you create or enter into Momentumly. You represent that you have the right to use that content and that your use does not violate law or the rights of others. Momentumly may process user content only as reasonably necessary to provide and support app functionality, subject to our Privacy Policy.

8. Intellectual Property

Momentumly names, branding, designs, website content, software, interfaces, graphics, and related materials are owned by or licensed to Eureka Digital Media unless otherwise stated. These Terms do not transfer ownership of Momentumly intellectual property to users.

9. Third-Party Services

Momentumly may rely on third-party platforms or service providers, including Google Play for distribution and billing and advertising services for the free experience. Third-party services are governed by their own terms and policies where applicable.

10. Product Changes and Availability

We may add, modify, suspend, or discontinue features; change plan limits; improve the interface; release new versions; or adjust pricing. We may perform maintenance or experience outages. We do not guarantee that every feature will always be available on every device or in every location.

11. Wellness and Productivity Disclaimer

Momentumly is a general productivity and personal growth tool. It is not medical, mental health, legal, financial, or professional advice and is not a substitute for qualified professional services. Goals, mood entries, habits, analytics, reminders, and motivational content are for personal organization and informational purposes.

12. No Guarantee of Results

We do not guarantee that using Momentumly will produce a specific habit, productivity, financial, wellness, academic, business, or personal result. Outcomes depend on many factors outside our control.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Momentumly and Eureka Digital Media will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the service. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to be responsible for claims or losses arising from your unlawful misuse of Momentumly, your violation of these Terms, or your infringement of another person's rights.

15. Privacy

Our Privacy Policy explains how information is handled when you use Momentumly and is incorporated into your use of the service.

16. Changes to These Terms

We may update these Terms as Momentumly evolves or when legal, operational, or platform requirements change. The “Last updated” date identifies the most recent revision. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
